Dismissal of Price Fixing, Restraint of Trade, and Monopolization Allegations
Edgeworth Partner Dr. Parker M. Normann provided expert testimony in the matter of McWane Inc and Star Pipe Products. The FTC dismissed six of its seven counts involving conspiracy, restraint of trade, and monopolization. The Commission effectively upheld the Administrative Law Judge decision dismissing the conspiracy allegations, while overturning the Administrative Law Judge on the finding of an unreasonable restraint of trade and monopolization regarding a vertical distribution agreement. This marks the first time in roughly two decades that the FTC has ruled against itself following an administrative trial.
