Edgeworth Helps Client Win Summary Judgment in California Rounding Case

In a class action filed in Superior Court of California, alleging improper rounding at a California hotel, plaintiffs claimed that when rounding resulted in time added, it was always paid at the base rate, but time removed by rounding would have been eligible for overtime premium pay. Dr. Deborah Foster applied the California overtime rules to the rounded and non-rounded time records to prove that, in fact, almost 30 percent of the time added by rounding received premium pay, and less than 20 percent of the time removed by rounding was eligible for overtime or double time premiums. Ultimately, the client won on summary judgment.
