Dr. Parker Normann Provided Expert Testimony in McWane, Inc Price-Fixing Case


Dr. Parker Norman provided expert testimony in the matter of McWane Inc and Star Pipe products. The ruling by the Federal Trade Commission (FTC) dismissed six of its seven conspiracy and monopolization allegations against McWane, Inc.. The Commission, in a split decision, effectively upheld the Administrative Law Judge’s ruling in favor of McWane on the agreement to restrain trade and invitation to collude, who relied in part on the “reliable, persuasive, expert opinion of Dr. Normann,” who testified at trial.

The Commission also reversed the Administrative Law Judge, finding that McWane’s distribution agreement was not an unreasonable restraint of trade. The dismissals mark the first time in nearly two decades that the FTC has ruled against itself following an administrative trial in its in-house court. The ruling was released publicly on February 6, 2014.
