Considering Welfare In ITC Exclusion Order Cases


Edgeworth partners Drs. Fei Deng, Gregory K. Leonard and Mario A. Lopez discuss economic factors that determine how an exclusion order would affect welfare in their Law360 article, “Considering Welfare in ITC Exclusion Order Cases.” 

Their discussion provides a list of significant factors that may affect consumer and total welfare from an exclusion order issued in a Section 337 ITC investigation. The authors suggest that because different issues will arise in each case brought before the ITC, companies should consider “public interest” as defined by general economic principles related to consumer welfare and producer welfare, rather than any one set of specific factors.
