In recent decisions involving class certification under Rule 23, the Supreme Court has elevated the standard for rigorous analysis by denying class be certified due to a lack of “rigorous” analysis of the relevant data to prove commonality of injury across plaintiffs. Mr. Fields and Dr. Prescott will discuss the lessons from decisions like Wal-Mart v. Dukes and Comcast v. Behrend for the certification of collective actions in wage and hours litigations, drawing from real world examples such as meal-breaks litigations.
