Webinar: Food Labeling Class Actions: Economic and Legal Perspectives on the Rule 23 Predominance Requirement

Consumer class actions involving allegations of false or misleading advertising by food manufacturers have proliferated in recent years.  A critical question in the class certification phase of these cases is the “predominance” of common issues with respect to consumer injury and damages.  

Dr. Jesse David, a partner at Edgeworth Economics, and Mr. Charles Sipos, a partner at Perkins Coie, will analyze the predominance requirement of Rule 23 from both economic and legal perspectives. Mr. Sipos will analyze damages decisions for food labeling class actions in the leading jurisdictions, discussing those courts' approaches to the levels of proof required for damages at both the class certification and summary judgment stage. Dr. David will identify economic techniques and data that may be used to evaluate “predominance” in particular cases and illustrate important issues related to damages models.
