Misclassification and Overtime Class Action

Plaintiffs alleged assistant managers at a nationwide big-box retailer were misclassified as exempt from overtime requirements. Edgeworth Partner Dr. Nathan D. Woods analyzed available opt-in responses to questions regarding alleged overtime hours worked to understand whether the responses were the same or similar enough to be representative of the proposed class.

He found extensive variation showing that no single measure of overtime hours could adequately represent the available opt-ins analyzed or the remaining opt-in class.
